Terms of Use

These Terms of Use (the “Terms”) are a binding agreement between you and Model Traffic LLC (“BookModels,” “we,” “us,” or “our”), governing your access to and use of BookModels at www.bookmodels.com and related services (the “Platform”). Please read them carefully. By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Platform. The Platform is not directed to and may not be used by anyone under 18. By using the Platform you represent that you meet these requirements and that the information you provide is accurate.

2. Your account

You are responsible for the accuracy of the information in your account and for keeping your login credentials secure. You may not share your account, create an account for someone else without authority, or maintain more than one account in a way intended to evade our rules. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.

3. The Platform and the marketplace

BookModels is a venue that lets Models publish profiles and lets Clients (brands, agencies, photographers, and event organizers) discover and contact Models. We are not a talent agency, employer, manager, or party to any arrangement, booking, engagement, or payment between Models and Clients. We do not negotiate, supervise, or guarantee any work, booking, fee, or outcome, and we do not guarantee that any Model will be contacted or that any Client will find suitable Models. Any agreement reached between a Model and a Client is solely between them, and they are responsible for their own conduct, contracts, taxes, releases, and compliance with law.

4. Your content and the controlling agreement

“Your Content” means anything you submit to the Platform, including photographs, video, profile text, and messages. As between you and BookModels, you retain ownership of Your Content.

The rights you grant BookModels in Your Content, and the representations you make when you submit it, are set out in the agreement that applies to your role and that you accept when you register or upload: the Model Participation and Content License Agreement for Models, and the Client Access and Platform Use Agreement for Clients. Those agreements control over this Section in the event of any conflict. For Models, that agreement includes a broad content and likeness license and a separately-signed consent governing any biometric and artificial-intelligence processing; you should read it carefully before accepting.

In summary, and without limiting those agreements: you grant BookModels a license to host, store, reproduce, adapt (for example, to create resized display variants), publish, display, and distribute Your Content in connection with operating and promoting the Platform and, for Models, the additional rights described in the Model Participation and Content License Agreement. You represent that you own or control all rights in Your Content, have obtained every consent and release required (including from anyone appearing in it), that every person depicted is at least 18, that Your Content is lawful and not sexually explicit, and that it infringes no one’s intellectual-property, privacy, or publicity rights. You are solely responsible for Your Content. Because copies and derivatives may be distributed and retained, removing Your Content from your profile does not guarantee removal of every copy.

5. Acceptable use

You agree not to:

• Post content that is unlawful, fraudulent, defamatory, harassing, hateful, or that sexualizes or depicts any minor in any way;
• Impersonate any person or misrepresent your identity, affiliation, age, or the rights you hold in content;
• Use the Platform for human trafficking, exploitation, escort or sexual services, or any other illegal activity;
• Harass, threaten, deceive, or defraud other users, or contact them for purposes unrelated to legitimate modeling work;
• Scrape, harvest, crawl, or bulk-collect data, profiles, images, or contact information, or use bots or automated means except as we expressly permit;
• Circumvent, disable, or interfere with security, rate limits, access controls, or fees, or attempt to access accounts or data that are not yours;
• Upload malware or disrupt the integrity or performance of the Platform;
• Infringe intellectual property or other rights, or violate any applicable law or regulation.

6. Fees, subscriptions, and payments

Some features are paid, including subscriptions and other paid placements or add-ons. Prices and features are shown at the point of purchase. Payments are processed by Stripe and PayPal, and by purchasing you also agree to the applicable processor’s terms. Unless stated otherwise, subscriptions renew automatically for successive periods until cancelled, and the then-current fee will be charged to your payment method at the start of each period.

You can cancel a subscription as described in your account settings; cancellation takes effect at the end of the current billing period and you retain access until then. Except where required by law or expressly stated, fees are non-refundable. We may change prices and features on a going-forward basis, with notice where required.

7. Our intellectual property

The Platform, including its software, design, text, graphics, and trademarks (but excluding Your Content and third-party content), is owned by BookModels or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purpose, subject to these Terms. All rights not expressly granted are reserved.

8. No verification or endorsement

We do not verify the identity, background, qualifications, statements, or content of users, and we do not endorse any user, Model, Client, or listing. You are responsible for your own due diligence and for your interactions and dealings with other users. Exercise caution and good judgment, particularly when meeting in person or sharing personal information.

9. Suspension and termination

You may stop using the Platform and request closure of your account at any time. We may suspend or terminate your access, remove content, or limit features at our discretion, including for violations of these Terms, suspected fraud or abuse, legal reasons, or risk to other users or the Platform. Following closure we may retain and deactivate certain information as described in our Privacy Policy. Sections that by their nature should survive termination (including content license survival, disclaimers, liability limits, indemnity, and dispute terms) will continue to apply.

10. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that any content is accurate or reliable. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, BookModels and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the Platform or any dealings with other users. To the fullest extent permitted by law, our total liability for any claim relating to the Platform will not exceed the greater of the amounts you paid to us in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars (USD 100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited by law.

12. Indemnification

You agree to indemnify and hold harmless BookModels and its officers, members, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Platform, your interactions with other users, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-laws rules. Subject to any mandatory consumer-protection rights you have in your country of residence, you and BookModels agree to the exclusive jurisdiction of the state and federal courts located in Nevada for any dispute arising out of or relating to these Terms or the Platform. Before filing a claim, you agree to first contact us so we can try to resolve the matter informally.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Platform after an update means you accept the revised Terms.

15. General

These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and BookModels regarding the Platform. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
